Something happened at the Shore Lodge in McCall in the early morning hours of February 1st. McCall Police agree with 53-year-old John Soderberg, who was visiting from Portland, Ore., that they came to his hotel room after police said they received a complaint of disturbing the peace.
But what happened after police arrived is not the subject of a claim against the City of McCall where Soderberg is seeking $500,000 in damages for what he says was a false arrest that has caused Him "issues regarding his employment."
The McCall Star-News reports that Soderberg was arrested on charges of resisting an officer and frequenting a place where illegal drugs were used. According to a police report, Corporal Dallas Palmer of the McCall Police Department, smelled marijuana coming from the room. Soderberg says Palmer forced his way through his hotel room door, wrestled him to the floor and handcuffed him.
Ultimately, the Valley County Prosecutor opted to dismiss the charges. But Soderberg has filed a claim against the City of McCall and asked for an independent investigation.
Soderberg's attorney, former Valley County Prosecutor Matt Williams, says McCall Police Chief Justin Williams has refused an outside probe. Meanwhile, Williams told the Star-News that he would not speak to the claim, but insisted that his internal investigation would be professional and objective.
