"I don't want to slap you. I don't want to wall you. I don't want to waterboard you, even if you're my enemy," Jessen says in the video deposition.
The deposition was part of a lawsuit filed against Jessen and Mitchell by the ACLU in 2015 on behalf of three men who were subjected to waterboarding, sleep deprivation, beatings, being forced into "stress positions" and other tactics outlined in the CIA interrogation program, which was brought to light in a 2014 report released by the U.S. Senate.
In an announcement, the ACLU said the plaintiffs are three of 119 victims and survivors of the CIA program. The suit was filed under the Alien Tort Statute, which pertains to "torture; cruel, inhuman and degrading treatment; non-consensual human experimentation; and war crimes."
The depositions of Jessen and Mitchell contradict accounts by others of the doctors' enthusiastic participation in designing the CIA program, as well as the doctors' own correspondence.
