Separate Investigations Into Two Idaho Lawmen Following Underage Sex Charges

Unless he can come up with $250,000 bond, an Idaho County lawman will spend his holidays behind bars, awaiting trial on charges that he had sex with an underage girl.

KLEW-TV reports that 31-year-old Daniel Funderburg, a deputy with the Idaho County Sheriff's Department, waived his right to a preliminary hearing and will be arraigned on Wednesday, Jan. 9.

Funderburg was placed on administrative leave in early December after being charged with having lewd and lascivious contact with a 16-year-old girl this past summer. Prosecutors said Funderburg admitted to having sex with the girl at his house. Investigators said the underrage girl contracted a sexually transmitted disease as a result of the sexual encounters.

Meanwhile, this morning's Lewiston Tribune reports that Kootenai County lawmen have launched an investigation, questioning if Idaho County Undersheriff Jim Gorges violated policies, procedures or the law because Gorges knew about Funderburg's behavior in November. The Tribune reports that court documents allege that Gorges "had worked everything out with the girl's mother." Funderburg said at one point, Gorges offered him a handshake and said, "Everything was good."

Gorges had been placed on paid administrative leave while the investigation continues.

It's common practice for law enforcement agencies to request outside help when an internal investigation is warranted.
