No mega-loads have budged yet from the Port of Lewiston, but that doesn't mean there isn't plenty of legal maneuvering. In the wake of the Nov. 1 ruling from the Idaho State Supreme Court—vacating District Judge John Bradbury's ruling to halt the permit process—the Idaho Transportation Department is still combing over the details of what happens next.
Attorney Laird Lucas of Advocates for the West, representing three Central Idahoans opposing the shipments, told Citydesk that he has filed two petitions with ITD to "intervene in the contested case." In effect, Lucas told Citydesk that his clients are asking for a full public hearing on the matter. On Nov. 2, Lucas filed a petition regarding the matter of the four ConocoPhillips drums awaiting shipments across Idaho's U.S. Highway 12. You can read the full petition here.
Lucas said he filed another petition Wednesday asking for separate hearings to consider more than 200 more shipments of ExxonMobil oil equipment across the same route.
ITD spokesman Jeff Stratten told Citydesk that a detailed review of the legalities of the matter continues with the Idaho Attorney General's Office.
