A Twin Falls magistrate, arrested in Boise in April for driving under the influence, will be heading back to Boise in August for her jury trial.
The Twin Falls Times-News quotes Boise police as saying 5th District Magistrate Judge Nicole Cannon had a blood-alcohol content nearly three times the legal limit when she was stopped on April 19 near the Riverside Hotel on West Chinden Boulevard.
Cannon, a former Minidoka County prosecuting attorney, was chosen to replace outgoing Judge Howard Smyser in Janaury 2011. Her biography said that Cannon had "specialized in the prosecution of child sexual offenses, drug offenses and DUIs."
The Idaho Code of Judicial Conduct requires judges to "conduct themselves in a manner that does not detract from public confidence in the integrity and impartiality of the judiciary."
The Times-News reports that eight judges disqualified themselves from hearing Cannon's case before 4th District Magistrate Judge Darla Williamson was assigned to the trial.
