The battle over the south steps of the Idaho Statehouse was won by the Idaho Atheists Association (IAI) when U.S. District Judge B. Lynn Winmill ruled Wednesday in their favor.
The IAI argued that due to the admitted mistake by state government officials they should not be forced to move their event to the side steps of the capitol making way for the National Day of Prayer rally.
Governor Dirk Kempthorne responded, I am disappointed in the judges decision, but it is important that we do not let a District Court ruling detract from our right and desire to gather and pray in public, if we so choose. As in past years, I will take part in the National Day of Prayer event, no matter where it is held, because of my own belief in the importance of prayer not to make a political statement. Its unfortunate that attempts to accommodate the Idaho Atheists, by offering them a very similar venue on the same day and at the same time, were rejected."
